1. About this policy
This Acceptable Use Policy ("AUP") sets the conduct and content rules for Smart Site Plan and is part of, and incorporated into, our Terms of Service. It applies to everyone who uses the Service, including users and seats you invite. Capitalized terms have the meaning given in the Terms. We may update this AUP as described in the Terms.
2. Prohibited activities
You may not use the Service to, and may not permit anyone to:
- Violate any law or regulation, or infringe or misappropriate any intellectual property, privacy, publicity, or other right.
- Access, tamper with, or use systems, data, or accounts you are not authorized to use, or attempt to defeat authentication or access controls.
- Probe, scan, or test the vulnerability of the Service, or breach or circumvent security or authentication measures, except as expressly permitted by our vulnerability disclosure process.
- Introduce malware, or interfere with, disrupt, overload, or impair the Service or its infrastructure.
- Circumvent or interfere with usage limits, rate limits, seat counting, metering, billing, or other access or security controls.
- Scrape, crawl, or harvest data, or use automated systems, beyond the limits of your plan, or resell, sublicense, or redistribute the Service without our written authorization.
- Reverse engineer, decompile, or attempt to extract source code, AI models, or underlying data structures, except where the law prohibits this restriction.
3. Content rules
You are responsible for the content you upload or share. You may not upload, store, or transmit content that:
- is unlawful, defamatory, harassing, abusive, fraudulent, or infringing;
- contains malware or is designed to harm or deceive;
- contains personal data you are not authorized to process, or sensitive data (such as government identifiers, health, or payment-card data) that the Service is not intended to store; or
- you do not have the rights to upload, share, or process.
4. Location, tracking, and surveillance
Smart Site Plan provides GPS and live location tooling for legitimate field and operational use. You may not use these features to unlawfully track, surveil, stalk, or monitor any individual. You are responsible for providing any notice to, and obtaining any consent from, the individuals being located that applicable law requires, and for complying with employment, privacy, and surveillance laws everywhere you operate.
You may not use the Service to geofence, target, or track people at or around sensitive locations, including health-care and reproductive-health facilities, places of worship, shelters, places that reveal political or union activity, or locations that reveal a protected characteristic. Tracking near health-care facilities to identify or message individuals is prohibited by law in some jurisdictions, and you are responsible for compliance.
5. Account integrity and fair use
One seat is for one named individual. Do not share credentials or a seat with others, and do not create duplicate, multiple, or false accounts, or use multiple identities, emails, or payment methods, to evade limits, seat counts, plan restrictions, eligibility rules, or promotions. Automated or high-volume access must stay within your plan's limits and must not degrade the Service for others.
6. AI features
You may not use AI features to generate content that violates this AUP, to attempt to extract or replicate the underlying models, or to submit content you are not authorized to share with a third-party processor. AI outputs are informational only and must be reviewed before you rely on them, as described in the Terms.
7. Enforcement and your redress
We may investigate suspected violations and, where warranted, remove or disable content, throttle, suspend, or terminate access, decline or reverse related credits, promotions, or trials, and report activity to law enforcement. We apply these measures proportionately and in good faith, and they do not affect any non-waivable rights you have under applicable law. Nothing in this policy obligates us to monitor content, and we are not responsible for content that violates it.
Where we remove your content or restrict, suspend, or terminate your account, we will, unless the law prohibits it or it would prejudice an investigation or someone's safety, tell you the main reason for the action and how you can respond. If you believe we acted in error, you can contact us at support@smartsiteplan.com to ask us to review the decision.
8. Reporting abuse or illegal content
To report a violation of this policy or abuse of the Service, email support@smartsiteplan.com. To report a security vulnerability, email security@smartsiteplan.com.
To notify us of specific content you believe is illegal (for example on a public share or form), email support@smartsiteplan.com with the location (such as the share link or page), a description of the content, and an explanation of why you believe it is unlawful, so we can assess and act on it. For copyright complaints specifically, follow our Copyright and DMCA Policy. This address is also our point of contact for users and for authorities regarding the Service.
